5 Steps To Help You Negotiate With Your Insurance Company For A Fair Settlement

5 Steps To Help You Negotiate With Your Insurance Company For A Fair Settlement

When disaster strikes, you want to know you’re cared for. Unfortunately, several horror stories exist about policyholders not getting the settlement amount owed for damage incurred on their homes.

An insurance dispute in Florida can be stressful and complicated. You may need someone else, like a public adjuster, to help you negotiate your settlement.

Regardless, it’s essential to cover as many bases as possible before hiring someone to negotiate your claim. To get a fair settlement, follow these steps to set yourself on the right foot.

1. Understanding your policy

Before filing an insurance claim, you need to make sure that you understand the ins and outs of your policy to negotiate a settlement effectively. Your policy will outline what benefits you’re entitled to and what exclusions or limitations may apply.

Understanding your policy will also help you avoid surprises or misunderstandings during the claims process. Suppose you’re unsure about any aspect of your policy. In that case, it’s a good idea to seek the help of an insurance adjuster or a law firm to clarify any questions or concerns you may have and to negotiate a fair personal injury settlement.

You’ll also want to be thoroughly aware of any exclusions or limitations affecting your claim. For example, did you know that homeowner’s insurance doesn’t cover damage to your home caused by acts of war? Consider consulting a personal injury attorney if the damage results from a car accident.

Although it’s unlikely that acts of war will affect your Florida home, you might want to be aware of these kinds of exclusions before you attempt negotiations with your insurance company. Understanding these exclusions is crucial for a personal injury lawyer advising clients on property damage claims.

You will also want to calculate the value of your damages to determine the maximum amount you may be entitled to receive. You’ll need to review your insurance policy and consider the following factors to negotiate with an insurance company for fair compensation:

  • The type of coverage you have: Your policy will outline what types of damages are covered and what exclusions or limitations may apply.
  • The amount of your deductible: Your deductible is the amount you’ll need to pay out of pocket before your insurance coverage kicks in; calculating this accurately is critical for determining the fair value of your claim. This calculation can impact the settlement with an insurance company, especially in disputes involving lost wages and personal injury.
  • The value of your damages: crucial for negotiating a settlement with the insurance company. You’ll need to calculate the cost of repairing or replacing damaged property, including labor and materials.
  • The limits of your coverage: Your policy will specify the maximum amount your insurance company is willing to pay for damages.

If you can, get a couple of different estimates on your damage to ensure you get a fair and accurate assessment of the value of your claim. A public adjuster can also help you in this area since they are up to date on the current prices of damage and repairs. This is crucial for ensuring you receive a reasonable settlement that covers all lost wages and damages.

Property Damage Claim Documentation

2. Gathering supporting documentation

When it comes to gathering supporting documentation, there is no such thing as not enough. Before-and-after photos can save you a lot of time and grief. Some of the additional documentation you should include will be receipts, photos, repair estimates, and any other costs relating to your damage.

For example, if you cannot use your home due to the damage and need to pay for a hotel, the hotel receipts should be included in your documentation.

Here’s an easy checklist you can follow for documentation purposes:

  1. Take photos and videos: Use your smartphone or camera to take clear, detailed photos and videos of the damages from multiple angles. Be sure to capture any visible damage and any underlying issues that may not be immediately apparent.
  2. Gather receipts and estimates: If you’ve already made any temporary repairs or obtained estimates for permanent repairs, gather these documents to support your claim.
  3. Keep records of all communication: Record all communication with your insurance company, including phone calls, emails, and in-person meetings. This will help you track the progress of your claim and provide evidence if any disputes or disagreements arise.
  4. Be thorough and accurate: When documenting damage, it’s essential to be comprehensive and accurate. Make sure you include all relevant details and provide as much information as possible to support your claim

Documentation with your insurance company, especially regarding communication (who you spoke to, when, and what they promised you) can help keep them on track for getting what you’re owed.

Unfortunately, many insurance companies, especially in Florida, are still trying to lowball their policyholders. Due to the influx of claims this hurricane season, they are trying to cut corners where they can. Therefore, documentation is vital to getting what you’re owed.

3. Filing your claim

When filing your claim, follow their instructions as thoroughly as possible.

There is a possibility that your claim will be thrown out if you don’t follow their instructions correctly. Your insurance company will likely have specific requirements and deadlines you need to follow.

The last thing you want is to have your claim thrown out because you waited too long to file. When in doubt, file your claim immediately after the damage.

Assuming you’ve thoroughly researched your policy and damages, you should know what you will be entitled to. Try to keep your expectations within a range rather than a specific number to give allowances for discrepancies. Again, a public adjuster can tell you whether your estimated settlement range is fair.

4. Negotiating with your insurance company

If you feel that your losses are within a sufficient margin to justify what your insurance company is offering, then it may be time for negotiations.

Most people prefer to do their negotiations themselves, especially if they’ve done their homework beforehand. If you can overwhelm your insurance holder with organized information, up-to-date research, and a thorough assessment of your damages, then progress can be made in negotiations.

Be patient but assertive in your negotiations. It’s essential to keep a calm and professional tone when in the negotiation process. The data you’ve collected should do most of the work for you.

Remember that many emotions are running high right now regarding Florida insurance claims. Every insurance office is flooded with claims from Hurricane Ian.

However, if you find that the process is taking longer than promised, not all the data is being considered, or they are unwilling to meet you halfway in your settlement, it may be time to bring in someone else for negotiations.

5. Handling disputes and appeals

If you believe you’ve been given an unfair settlement offer, you can try to negotiate directly to reach a fair settlement. However, you will likely need to take more drastic action.

If you cannot reach an agreement with your insurance company through direct negotiation, you may be able to seek the help of a mediator or arbitrator to resolve the dispute. These options can be less formal and less expensive than going to court, and they may be able to help you resolve more quickly.

You may need to appeal the decision if your dispute can’t be resolved through negotiation or mediation. If you decide to appeal a denied claim, it’s important to understand the appeals process and follow the proper procedures. This may involve submitting additional documentation or presenting your case to a panel of arbitrators or judges.

When this doesn’t work, you’ll want to immediately hire a reliable public adjuster. These professionals are skilled at negotiating with insurance companies and know the language that will help you get what you’re owed to cover your damages.

The best thing you can do is understand the insurance claims process as thoroughly as possible. Don’t just take the first offer; ask them to explain how it’s a fair settlement for your incurred damages.

9 Water Damage Insurance Claims Tips To Help You Get Covered

9 Water Damage Insurance Claims Tips To Help You Get Covered

[zynith-toc]

In the event of water damage to your home or property, are you prepared? How can you make sure your water damage claim will be covered by insurance?

Water damage to homes is especially prevalent for Florida homeowners. In fact, the frequency and intensity of water damage, especially caused by broken or leaky pipes, has increased by 46% percent since 2010.

In this day and age, many Florida insurance policies can deny a claim if there is a presence of mold or if a leak has been present for more than 14 days. Staying on top of water damage insurance claim knowledge could save you a painful conversation with your insurance company if one of these things happens to you.

First, be sure you know what is typically covered by insurance policies for water damage:

  • Plumbing or appliance malfunction
  • Burst pipes
  • Leaky roofs

Now, here are some types of water damage not typically covered by insurance:

  • Groundwater leaking into basements
  • Flood damage
  • Damage from long-term leaks or sewage issues
  • Mold, rot, or fungus
  • Sewage or pipe backup

We know navigating water damage loss can be stressful and overwhelming. To help you out, here are the top nine water damage insurance claim tips you should remember.

Preventative measures:

1. Document your home and belongings

If you know you live in an area prone to water damage, you should make sure to document your home and belongings well. Keep photos and videos in a storage cloud where they can easily be retrieved in the event of an emergency.

Keeping an inventory and photos of your home and belongings could really help you in the case of an emergency. You’ll be able to easily provide evidence of the full scope of your losses to the insurance adjusters.

Even if you don’t live in an area prone to water damage, this type of index is generally a good idea. It’s helpful based on what we’ve seen, especially with Florida residents and the yearly threat of hurricane and storm damage.

2. Check the kinds of damage you are covered for

There are some kinds of water damage that are not covered by insurance. Make sure you know what’s on your policy and what you are covered for.

For example, flood insurance is not covered by homeowners insurance. If flooding is something you are concerned about, make sure you’ve added that type of insurance separately.

Flood insurance can only be handled through the National Flood Insurance Program. You can learn more about flood insurance on the FEMA website here.

You don’t want to be caught in a situation where you think you are covered by your insurance policy, only to realize you are completely responsible for your losses in the case of a disaster. Take the time now to become acquainted with the details of your policy.

3. Make sure your home is safe

Take the opportunity now to make sure your home is safe and protected from any type of predictable natural disaster that could happen in your area.

Make sure inspections are up-to-date and regular maintenance is done on possible sources of water damage. Any preventative measures you can take to make sure your pipes don’t burst will save you a lot of headaches in the long run.

In the event of damage:

4. File a claim right away

In the event of water damage to your home or property, don’t wait to file an insurance claim. File a claim quickly, so the insurance adjuster can take a look at the damage as quickly as possible.

Water damage can displace you from the regular routine of your home. If you have to turn off water or power, evacuate the home, or replace essentials, you won’t be able to live in your home as normal until the damage has been fixed. File a claim quickly so you can avoid extended stays in hotels or with family.

This is especially important in the event of a storm or hurricane, where insurance adjusters may be busy with several claims. Since they usually operate on a first-come, first-served basis, get in line as early as possible for this process.

5. Document all damage

Take pictures and videos of the damage as early as possible, even before clean-up has started. Get pictures and videos of standing water before you drain it, and make sure you’ve done the same for furniture and belongings as well.

This is why it’s helpful to have a documented index of what your home and property were like before any damage occurred. Although it isn’t always necessary, it certainly helps, especially if you and your insurance company aren’t coming to an agreement on the estimated cost of losses.

For valuables, you can add when they were purchased, how much they cost, and the current value of the items. This can help streamline the insurance claim process.

6. Drain any standing water

Then, of course, clean up whatever you can to prevent further water damage. Drain any standing water as quickly as possible after it’s been thoroughly documented.

Hopefully, this will stop the spread of water damage to your floors, foundation, or other parts of your home.

7. Dry areas affected by water damage

Dry out the areas affected by water damage as best you can. This can be especially difficult for carpeted and water-logged areas, but can help prevent mold growth when done correctly.

If you do end up getting some type of mold growth due to water damage, it usually results in having to file another insurance claim. Be sure to be as thorough as possible while drying your home and possessions to avoid this.

Here are some helpful ways to dry water damaged areas:

  • Open windows and doors: if the humidity allows, get air moving through the house as quickly as possible and leave open for a long time.
  • High powered fans: You can usually buy or rent industrial fans to help speed up the drying process:
  • Sump pump: If you have several inches of standing water, this may be a good option for you since it will pump water out through a long hose.
  • Wet/dry shop vacuum: An industrial shop vac built for water usage can help save rugs and carpets from permanent damage.

Check out some more resources here to help thoroughly dry your home and belongings.

8. Negotiate if needed

You can actually negotiate with your insurance company if you are unsatisfied with your claim outcome. For smaller claims, this may not be much of an issue. For larger claims, it may be worth getting on the phone to see if you can get a more fair settlement for your losses.

If your insurance company still won’t budge, you do have another option-

Plumbing Damage Claims Riverview Fl

If you’re unsatisfied with your claim:

9. Hire a public adjuster

If needed, you can hire a public adjuster to help you get a better settlement.

A public adjuster is an independent, licensed professional specialized in getting fair insurance settlements for policyholders. They will handle the claim dispute for you, and are well-versed in effectively negotiating with insurance companies.

In the case of a water damage claim, make sure you hire a public adjuster that thoroughly understands the type of damage to your home. This can help out your claim immensely if it is handled by an expert on the subject.

Typically, hiring a public adjuster is reserved for larger claims. For smaller claims, the disputed amount may be equal to or less than the adjuster’s fee, so it might not be worth the trouble. For larger claims though, it could save you thousands of dollars.

So, to recap, here are the main tips you should remember around water damage insurance claims:

  • Take preventative measures if you can: make sure your house and plumbing are properly maintained.
  • Document home and belongings beforehand: if you can, keep an index of photos, videos, and specifications of your home and belongings.
  • File a claim right away: in the event of damage, file an insurance claim right away to get the ball rolling and limit time in recovery.
  • Document all damage thoroughly: take thorough pictures and videos of water damage
  • Dry everything to prevent further damage: and hopefully avoid another insurance claim or time spent living outside your home

With a little research, preventative measures, and the right professionals, you should be able to move through the insurance claim process with relatively few hiccups. Try to prepare for or prevent water damage if you can. If you haven’t been able to prepare in the event of an emergency, make sure the right professionals are on your side.

The Top 7 Public Adjuster Myths Busted

The Top 7 Public Adjuster Myths Busted

Have you had an insurance claim not go your way?

Maybe you are facing the grim reality that your insurance company is not giving you enough to cover the full cost of damages. Many people feel at a loss for what to do in this situation.

Perhaps you have considered hiring someone to be an advocate for your case. After doing a little research, perhaps you’ve heard some unsettling rumors about public adjusters as a whole.

This is pretty normal, lots of insurance professionals will have negative biases around them, especially when insurance money is at stake. We’re here to help you sort through these rumors.

If you can overcome the nay saying about public adjusters, it can completely change the course of your insurance claim. The price of not doing so could mean thousands of dollars you have to pay out of pocket, so let’s tackle these myths about public adjusters.

1. Hiring a public adjuster will raise your premium

Your insurance company probably won’t like it if you hire a public adjuster. When public adjusters are involved, they usually end up having to pay more, so it makes sense that they wouldn’t be thrilled.

However, insurance companies are legally restrained from raising your premiums just because you’ve chosen to hire a public adjuster. Most often, premiums are raised because they have gone up for the entire region. This is common after a natural disaster has occurred, such as a hurricane, tornado, or flood. In Florida especially, homeowners insurance premiums usually go up every year.

If you choose to file a claim, one claim will likely not raise your premium. If you have multiple claims filed in a certain time though, this could result in a raised premium though.

Riverview Public Adjusters Near Me

2. Public adjusters take a huge part of your insurance payment

A public adjuster should present you with a contract outlining their services and fees. Most of the time, they can only take a percentage of the insurance settlement, so you shouldn’t be blindsided by how much they charge for their services.

In most cases, including ones of catastrophic disasters, public adjusters are capped for what they can collect at about 10%.

We would caution you against hiring a public adjuster that charges a fee upfront for their services, or ones that work on an hourly or retainer basis. When a public adjuster only collects a percentage of your insurance settlement, then you know they only benefit when you do. They will be more motivated to win your case.

If 10% still seems too high, then consider all the work that a public adjuster will be doing for your case. They will likely be filing all the claims paperwork, writing up a damage report, as well as meeting and negotiating with the insurance company. It ends up being a large amount of work to make the process easy for you as the homeowner.

3. Public adjusters don’t have your best interest in mind

Public adjusters are in business to advocate for policyholders. If you’re hiring a quality public adjuster, they will be motivated to advocate on your behalf because it helps their business thrive.

Public adjusters will have passed a background check and have been fingerprinted in order to advise and represent you. Any criminal charges they get will lead them to be barred from adjusting or banned from getting a license.

This being said, sometimes scammers posing as public adjusters will take advantage of an area that’s experienced a natural disaster. For this reason, check the reviews and reputation of the public adjuster you are considering.

A decent public adjuster will have your best interest in mind, and only benefits when you do.

Riverview Loss Adjusters

4. Your insurance will drop you if you use a public adjuster

Insurance companies are at liberty to drop a policyholder at any time regardless of the reason, except for in the middle of a policy period. They are not at liberty to drop you because you’ve hired an advocate for yourself.

If an insurance company drops someone, it’s likely due to neglecting payments or underlying issues that have been in the works before a claim was made.

Although it’s not strictly impossible to be dropped, if you have a legitimate claim there shouldn’t be any worry about your insurance company dropping you. In Florida, the government has a state-run insurance company that can help you out if something does happen with your insurance company. They help people get competitive rates for those who are unable to get insurance.

5. Public adjusters commit insurance fraud

A public adjuster’s job is to build a case for the policyholder based on state statutes. The negotiation process between a public adjuster and an insurance carrier is much like that of a court trial.

The only thing both the insurance company and public adjuster have to work with is the law, the previously outlined policy, and the actual cost of repairs. It’s hard to deceive either party out of a great sum of money with these parameters.

Some of the pushback around public adjusters is from insurance companies themselves because they know they will likely end up paying more for a claim settlement. The public adjuster is skilled at pointing out things that they may have overlooked in their own assessment, which bodes well for the homeowner.

Working with a public adjuster is not insurance fraud, insurance companies just don’t like it.

Furthermore, if a public adjuster is found associated with insurance fraud, they lose their license and are unable to get it back ever. Most would not risk their career and reputation for insurance fraud.

6. Public adjusters are untrustworthy

Once again, a reputable public adjuster will have your best interest at heart. Their business will only benefit if you do.

If you still have doubts, ask for referrals, references, or testimonials from a public adjuster you are considering. Their reputation should be able to speak for them if they have been able to get results for other people who have been in similar situations as you.

It’s understandable if you have hesitations about hiring a public adjuster. However, consider how much you could stand to benefit if hiring a public adjuster goes well for you. Hiring a quality public adjuster could mean additional thousands of dollars to cover the costs of your damages.

Most importantly, do thorough research on the adjuster you are considering hiring. Thorough research should weed out any untrustworthy professionals, as well as help you feel confident that you will benefit from hiring a public adjuster.

7. Your insurance adjuster can do the same thing as a public adjuster

Although an insurance adjuster and a public adjuster both come out to your property, inspect the damage, and come up with an estimated cost of repairs, there is a stark difference between the two.

Your insurance adjuster works for your insurance company. Meaning, they benefit the most when the insurance company does. They may be more likely to overlook the extent of the damage that has been incurred.

A public adjuster, hired by the policyholder, will want to get the fairest settlement for the homeowner. Unfortunately, their job is necessary because many insurance companies will want to give a smaller settlement to their policyholders than what they are entitled to.

So, though they are similar professionals, hiring a public adjuster will likely result in you getting a higher coverage for the damage you’ve sustained.

All in all, overcoming any of the doubts you have about hiring a public adjuster could make a huge difference in the outcome of your insurance claim.

Many people who hire a public adjuster appreciate having a guide and advocate that can handle all the details they don’t understand for themselves. Their negotiation skills and knowledge of the industry help the process go smoothly.

Hurricane Ian Update: Relief and Rebuild

Hurricane Ian Update: Relief and Rebuild

The state of Florida is still navigating the aftermath of one of the most devastating hurricanes in recent history. Hurricane Ian is still the center of many people’s lives as they sift through their losses.

Too many people are coping with losing pretty much everything. At the very least, everyone has suffered some inconveniences or discomfort after Ian. Nearly everyone has questions, and not everyone you turn to is prepared to be honest with those who are looking for help.

A few weeks after the disaster, we’re here to provide you with an update on what the state of Florida and the insurance landscape looks like.

What has been happening in Florida since Ian hit?

Driving through Florida likely doesn’t look the same as it did before Ian. What you see on the news might not be the full extent of the damage, but here are a couple highlights people have been focusing on:

  • Sanibel Causeway: Approximately five sections of the Sanibel Causeway were washed away in the hurricane. This left the residents of Sanibel Island stranded either away from their homes or on the island. What would have normally taken months to repair was provided a temporary fix in just a couple weeks, with teams of workers working around the clock to restore access to the island.
  • Flesh-eating bacteria: It’s likely few Floridians thought to worry about flesh-eating bacteria prior to the hurricane, but the rise in the bacteria has been affecting areas that were hit by Ian. The bacteria, necrotizing fasciitis, is found in warm, brackish water. Although it’s safe unless it enters the body through a wound, the mortality rate for those who are infected is about 20%
  • Agriculture loss: The hurricane is believed to have caused at least $1.2 billion in damage to the Florida agriculture industry. Nearly half of all citrus acres in the state were hit by the hurricane. If you’re experiencing a price hike in your typical OJ or other grocery items, Ian’s likely responsible.
  • How this affects Florida’s economy: Although the hurricane will put a damper on Florida’s economy for the remaining quarter of the year, natural disasters don’t typically have a large negative impact on economies. The real damage comes to individuals and small businesses that have been devastated by the hurricane, and it’s these people who will have the hardest uphill battle post-Ian.

With all these scenarios stacked on top of each other, it’s easy to see that not everyone will stay calm while navigating the aftermath of the storm. Some people or companies will be motivated by fear or desperation to take action after the storm. Keep this in mind as you make decisions about your home or insurance in the next couple weeks.

Hurricane Flooding Damage

The insurance scene post-Ian

Many Floridians still struggle to pay for their homeowner’s insurance. Unfortunately, too many people are now finding out that this same insurance they’ve been struggling to pay does not cover the damage of flooding from the storm.

Here’s what you need to know about the current landscape of Florida’s insurance market:

Flood insurance

As stated, many people are only now finding out that their homeowner’s insurance does not cover damage caused by flooding. This is leaving many people having to prove that their damage was caused by hurricane winds, rather than floods. However, flooding from a hurricane can devastate a home or building due to the mold growth that inevitably comes.

Homeowners insurance stopped covering flooding in the 1960s, because the risk of damage during a flood is high, nearly inevitable. FEMA was created as a result.

There are several areas in Florida that are considered “flood zones” and require people to have flood insurance if they own property in those areas. Only 15% of households in Florida have flood insurance.

85,000 Floridians had just dropped their flood insurance last year. Insurance companies are now asking these customers to pay at least part of their claims out of pocket, even though they were told by their agents that they were covered.

FEMA did just announce that they are extending the grace period for those affected by Hurricane Ian and whose policy recently expired. You can read more details here.

The extension is being made in response to the number of policyholders who have been unable to access their homes due to flooding and other post-storm damages. The extension will also allow additional time for policyholders who are still waiting on an adjuster or other necessary information from their insurance companies.

The extended deadline applies only to homeowners and commercial policies affected by Hurricane Irma. It does not apply to flood insurance policies purchased through the National Flood Insurance Program (NFIP).

Most people get about $5k in aid. This should help cover living expenses and anything you need as you’re waiting to get an insurance agent out to inspect the damage.

Homeowners insurance

Florida homeowners already pay significantly more for their coverage than nearly any other state in the US. With the devastation from Hurricane Ian, premiums will likely increase by 20-30% next year.

Proving that the damage to a home is caused by the hurricane winds is what many people are working towards now, since wind damage is covered by homeowner’s insurance.

A private study predicts that many local insurance companies will have to file for bankruptcy due to the devastation from Hurricane Ian

What’s not being said by insurance companies outright is that they will be doing everything they can to pay as little as possible to the people affected by the hurricane. Remember, they are a business trying to stay afloat during a crisis. Many have said that they can’t afford to pay what they owe everyone.

Hurricane Ian Waves Breaking

Florida going forward

So, everyone is wondering, what does the future of Florida look like? Here are the predictions we have so far.

Florida has had one of the biggest housing booms in the nation for the last couple years. Will this continue in a post-Ian Florida?

Even before Ian hit, the housing boom as a result of the pandemic was already starting to slow down. Hurricane Ian will likely slow down the market, but the desire to live in Florida isn’t going anywhere, even considering the risks.

If you’ve experienced damage, you need to contact your insurance carrier as soon as possible to assess the damage. Have a Public Adjuster at the ready, because you will likely need to debate your case.

Lastly, if you’ve made it out of Hurricane Ian relatively unscathed, there are several organizations you can donate to in order to help. Here are some we recommend:

One of the best things you can do during this time is to make sure that you are getting what you’re owed for the damage you’ve suffered. If Florida is going to rebuild, its homeowners and business owners can’t be struggling to raise funds for repairs they’ve already insured.

If you or someone you know needs an advocate to help your case, get a Public Adjuster on speed dial. A well-qualified Public Adjuster is skilled at negotiating the ins and outs of your policy, especially during times of crisis.
